I. Introduction
Marriage in India has always been framed as sacred.
Laws and statutes addressing dowry, cruelty, and domestic violence were introduced to protect women historically seen as vulnerable within the institution.
But now, a darker reality is emerging: men too are facing harassment, false allegations, financial ruin, and even sexual violence.
II. Liabilities Men Shoulder
When marriages collapse, men often bear the heavier side of legal obligations:
Maintenance & Alimony (Sec. 24 & 25 HMA):
Courts award interim and permanent support, even if the wife is capable of earning.
Child Custody & Support (Sec. 26 HMA):
Custody generally goes to mothers; fathers remain financial providers.
Return of Stridhan/Dowry Articles:
Non-compliance can invite criminal charges.
Property Issues:
Jointly owned assets are divided; the husband’s contribution is scrutinized.
Criminal Exposure:
498A IPC, Dowry Prohibition Act, and the DV Act can be invoked, sometimes with little prima facie scrutiny.
